BSP Helps Secure Defense Verdict for Yamaha in Off-Road Vehicle Rollover Case

Bush Seyferth attorney Derek Linkous served as embedded appellate counsel alongside Snell & Wilmer’s trial team, helping secure a complete defense verdict for Yamaha Motor Corporation, U.S.A., and related entities following an eight-week product liability trial involving a Yamaha YXZ side-by-side rollover.

Plaintiffs alleged defects in the vehicle’s rollover protection structure and rear suspension and sought $80 million in compensatory damages and $240 million in punitive damages. Yamaha demonstrated that the rollover resulted from driver error and that the vehicle’s rollover protection structure exceeded industry strength standards and performed as designed.

After approximately 90 minutes of deliberation, the 12-person jury returned a verdict for Yamaha on every count.

Derek’s work alongside the Snell & Wilmer team contributed to this outstanding result for Yamaha.
