BSP Wins Dismissal of Putative Class Action

Representing SAS Institute Inc., a major international software company, BSP attorneys Stephanie Douglas and Susan McKeever won dismissal of a putative class action pending in the Eastern District of Michigan. The lawsuit claimed that tens of thousands of Michigan unemployment recipients had been deprived of procedural due process when they were “auto-adjudicated” as fraudulent through software used by Michigan’s unemployment insurance agency. In a reasoned opinion, the district court held that neither SAS nor its software had any involvement in the plaintiffs’ claimed injuries and therefore the plaintiffs lacked standing to sue SAS.
