BSP Attorneys Win Pre-Discovery Motion

On behalf of FordDirect, BSP attorneys Patrick Seyferth and Derek Linkous won a pre-discovery motion to dismiss in an employee-benefits case and the Court denied leave to amend the complaint. The plaintiff asserted that she was entitled to additional distributions from FordDirect’s Long Term Incentive Plan beyond those allocated by the Plan Administrator.  Judge Michael Warren of the Oakland County Business Court rejected Plaintiff’s contractual interpretation and affirmed that when an employee-benefits plan is delegated interpretative discretion, “the Court only determines if the [employer] acted reasonably, not whether there were other permissible course of conduct.”
