9.24.21 – Bill McDonald to Moderate Panel at Trial Network Product Liability Conference

On Friday, September 24, Bill McDonald will be moderating a panel at the 2021 Trial Network Products Liability SuperCourse in Minneapolis, MN.

Bill will be moderating a break-out session entitled, “Total Recall: Navigating the ‘Phantom Defect’ Claim.” This presentation will discuss how, in some vehicle product recall cases, a recall condition did not actually cause the accident or injuries, but the “phantom defect” still comes into play in the lawsuit. The session will offer best practices in creating strategies to effectively disprove that the recall was at issue and strategies for dealing with a plaintiff’s res ipsa theories that introduce evidence of defendant negligence.
