Derek Linkous and Lane Morrison Win Appeal Affirming Summary Judgment in Tenth Circuit

BSP Law recently won an appeal affirming summary judgment in the District of New Mexico in an airbag non-deployment case. On Plaintiff’s appeal to the Tenth Circuit, attorneys Derek Linkous and Lane Morrison successfully argued that New Mexico law required plaintiff to present expert testimony of both defect and enhanced-injury causation and that he had failed to do so. The court agreed and fully affirmed the trial court’s grant of summary judgment for BSP Law’s client and agreed that there were no issues that needed to be certified to the New Mexico Supreme Court.
