BSP Wins Post-Trial Affirmance of Prior Defense Verdict in $100 Million Jury Trial for Automaker
BSP’s Derek Linkous recently won affirmance of a jury verdict for an automaker in a case tried by BSP’s Patrick Seyferth and Bill McDonald. Plaintiff, the mother of a paralyzed girl, brought design and warnings claims related to the seatbelt in a three-row SUV. Plaintiff sought more than $100 million in closing arguments. BSP’s trial team successfully argued to the jury that the seatbelt’s design was robust and the warnings were extensive. The jury returned a verdict of no fault after the multi-week trial in less than two hours. On post-trial motions, the Indiana state court judge rejected all grounds raised by the Plaintiff for a new trial.
